DMCA Policy

WVault respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), WVault will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

Filing a DMCA Takedown Notice

If you believe that content hosted on WVault infringes your copyright, please send a written notification containing the following information as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit WVault to locate the material (e.g., the URL of the content).
  4. Your contact information, including address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Submit a Notice

You may submit a DMCA takedown notice through our online submission form.

Counter-Notification

If you believe that content you posted was removed by mistake or misidentification, you may submit a counter-notification containing the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original DMCA notification.

Response Time

WVault will process valid DMCA takedown notices within 24 hours of receipt. Content identified in a valid notice will be promptly removed or disabled.

Repeat Infringers

WVault maintains a policy of terminating the accounts of users who are repeat infringers in appropriate circumstances.
